To qualify for an Adult Dependent Relative Visa, the applicant must demonstrate a genuine need for long-term personal care due to advanced age, severe illness, or a disabling medical condition. Moreover, it must be proven that such care is either unavailable or unaffordable in the applicant’s home country.

Meeting these requirements can be highly challenging. Even if the applicant satisfies the health-related eligibility criteria, proving the financial aspect can be more difficult. Many sponsors who can sustain and accommodate their dependent relative for an extended period—typically up to five years—often struggle to provide convincing evidence that they cannot arrange or fund adequate care for their relative in their country of residence.

If the sponsor is permanently settled in the UK or holds British citizenship, the Adult Dependent Relative may be granted indefinite settlement upon approval of the visa. Conversely, if the sponsor has only temporary immigration status, the visa granted will mirror the sponsor’s temporary leave to remain. Once in the UK, the dependent relative may later apply for settlement or further permission to remain, in line with the sponsor’s visa status.

There is also a distinct pathway available for Adult Dependent Relatives of BN(O) Status Holders, as outlined in the Appendix Hong Kong British National (Overseas) regulations.

Importantly, this visa route is exclusively open to applicants outside the UK. Switching to the Adult Dependent Relative route from within the UK is not permitted under the current immigration framework.
